The trademark department includes 12 full time trademark

The following is our activities after the revision of Chinese
Trademark Law
3D
trademark and color combination trademark
In March 2002, Wan Hui Da, assisting China Trademark Association,
organized a “Seminar on the Registration and Protection
of Three-Dimensional Trademarks and Color-Combination Trademarks”,
invited the legal experts in trademark law from the EU,
France and China to make speeches. More than 180 people
from the China Trademark Office, Trademark Review and Adjudication
Board, the People’s Courts and trademark agencies attended
the seminar. This event played an important role in the
understanding of the new themes of “three-dimensional trademarks”
and “Color Combination trademarks” for the sectors involved
in the trademarks.
Submitting application for registration of 3D trademark in the first day of the new Law
On December 1, 2002, the first day that the revised Chinese
Trademark Law was implemented, Wan Hui Da, representing
several clients, submitted the application for registration
of 3D trademark, which was newly introduced by the law.
This relies on the pre-study of the law and the early communication
with the clients.
The
First Claim of Exhibition Priority in China
The revised Trademark Law provides exhibition priority
while the Chinese Trademark Office provides no specific
regulation and evaluation criterion for the exhibition priority,
Wan Hui Da, thanks to its better understanding to the legislation,
submit the application for registration of trademark with
the claim of exhibition priority in China. Without any precedents,
our attorney provided the client with detailed advices after
the filing and actively communicated with the relevant officials,
finally got the approval for the exhibition priority.
Well-known
Trademark Identification and Protection
Since the announcement of the “Regulation on the Identification
and Protection of Well-known Trademarks” on June 1, 2003,
Wan Hui Da trademark attorneys conducted immediate and systematic
research and study into this new issue. By the end of 2003,
Wan Hui Da has, representing both domestic and foreign clients,
submitted over 10 applications for Identification of well-known
trademarks, including some world famous grands like “Gillette”,
“Michelin”, “L’Oréal”, “ZIPPO”, etc. In the processes, Wan
Hui Da attorneys made best solution of procedures in accordance
with various situations of the cases, provided detailed
guidelines for the clients to collect supporting evidence,
and also put all the efforts in coordinating and communicating
with the relevant authorities, in order to push the cases
forward smoothly.
Gillette is in the first batch of Well-known Trademark identified
In August 2003, Wan Hui Da investigator discovered that
a cosmetic company in Yiwu city was producing toothpastes
with the trademark of “GILLETTE”, while the client has failed
to register the trademark of “GILLETTE” on toothpastes.
Our attorney realized that it was a golden opportunity to
get the well-known trademark identified for Gillette, and
reported to the client with comprehensive advice on collecting
of evidence. As requested by the client, an application
was filed. After the filing, we put a lot of efforts to
push the case forward, i.e., the procedure of transferring
the application from local administration for Industry and
Commerce (AIC) to the State AIC. We finally succeeded in
having Gillette identified as a well-known trademark, which
is the one of the only two foreign brands being identified
among the list.
