Overview

Weifeng Sun is a senior patent counsel at Wanhuida Intellectual Property, holding both patent attorney and lawyer qualifications. He is a member of the Beijing Lawyers Association's Foreign-Related Lawyer Talent Pool. He is qualified to practice law in California, USA, and has passed the US Patent Bar Examination. After obtaining an LL.M. degree in intellectual property in the US, he interned at a local patent law firm in California, gaining familiarity with US patent prosecution and litigation practices.

 

With over seventeen years of experience in the patent field, Mr. Sun has been involved in foreign-related patent applications and subsequent matters since joining Wanhuida in 2016. He currently focuses on patent matters, including patent infringement, patent invalidation, and patent administrative litigation in the mechanical field, as well as non-litigation matters such as FTO/infringement analysis and patent validity analysis.

 

Mr. Sun previously worked at the Patent Office of the National Intellectual Property Administration (CNIPA), where he was engaged in the substantive examination and reexamination of invention patents in the construction and mechanical fields for over eight years. He also served as a mentor for new examiners at the Patent Examination Cooperation Jiangsu Center, responsible for training and guiding new examiners.

  • "(2021) Supreme Court Zhi Xing Zhong 78, 79" won the "Deal of the Year" award at the 2021 China Business Law Journal
  • "(2018) Jing Xing Zhong 4547" and "(2018) Jing Min Zhong 564" were selected as representative cases in the "2018-2019 Intellectual Property Litigation Patent Elite List" by IP House (Zhichanbao)

 

Selected other important cases he has handled include:

  • Represented a French company in a second-instance administrative litigation at the Supreme Court involving a complex mechanical device; later invited to participate in a symposium organized by the Intellectual Property Committee of the National Lawyers Association and the Intellectual Property Tribunal of the Supreme Court, and spoke as a representative lawyer in the first public live trial during the Supreme Court IP Tribunal's "426 Public Open Week."
  • Represented a Swiss company in patent infringement lawsuits at the Beijing Intellectual Property Court and Shanghai Intellectual Property Court, among others, achieving favorable outcomes; also represented the company in invalidation proceedings at CNIPA, successfully maintaining the patent's validity in the fifth and sixth invalidation challenges, thereby securing the ongoing infringement lawsuits
  • Represented a French company in a second-instance patent infringement lawsuit at the Supreme Court involving a hair styling device, where the Supreme Court supported the claim interpretation, laying the groundwork for continued rights enforcement
  • Represented a Swiss company in a patent invalidation proceeding at CNIPA involving a coffee capsule, successfully invalidating the competitor's patent by leveraging prior art interpretations, clearing the way for the client's new product launch
