Administrative enforcement is an important component of Chinese IP protection. We enforce over a thousand cases each year on trademark, patent, copyright and unfair competition. Particularly in trademark area, we are experienced in working with numerous agencies under the State Administration for Market Regulations (SAMR). We also have extensive experience working with customs, local IP offices, food and drug regulator and other authorities for protecting client IP rights. In many of our cases, we were successful in coordinating administrative and judicial enforcement to eliminate infringer's network and to obtain damages. Our enforcement and litigation practice frequently work together to serve the purpose of rapid strike and physical evidence gathering.


Obtaining evidence for enforcement is often a challenge in China. To support our litigation and enforcement services, we have a team of professional investigators and an extensive network of investigation for evidence gathering. We have had experience in obtaining difficult physical evidence for our clients. We are also experienced in dealing with technical evidence and electronic evidence and working with third party experts, such as technical appraisal and electronic evidence experts, to address the most challenging evidence issues.

Landmark Cases

SPC Top 50 Cases: Representing ABB in bringing a private criminal prosecution against a counterfeit seller before a primary court in Wuhu, which found exporter Teaton and its owner Zhang guilty of selling goods bearing counterfeit registered trademarks, sentencing Zhang to 3.5-year imprisonment and imposing RMB 800,000 fines to Zhang and RMB 850,000 fines to Teaton. Both defendants appealed to the Wuhu Intermediate Court, which upheld the decision of the court of first instance.


SPC Top 50 Cases: Representing L'Oréal in coordinating Shanghai PSB and the PSB authorities in 4 provinces to launch a coordinated raid operation against 16 targets. The action led to the apprehension of 13 suspects and seizure of substantial amounts of counterfeits. The case was later prosecuted before the Shanghai courts, which led to the conviction, imprisonment and fines of 10 culprits.


MPS Top 10 Cases: Representing a leading multinational alcoholic beverage maker in coordinating the law enforcement officials of Shanghai PSB in launching a series of coordinated raid actions against a major syndicate engaged in manufacturing counterfeit wines, which led to large seizures and the detention of 41 suspects.


Shanghai Pudong Court Top 10 Cases: Representing CIVB in holding Shanghai Feitong and its actual operator ZHUGE criminally liable for counterfeiting geographical indication collective trademark "Bordeaux".


Hangzhou Procuratorate Exemplary Cases: Representing a trade secret owner in the criminal prosecution proceeding against an employee seeking to misappropriate and patent the said trade secret. The defendant was sentenced to 4-year imprisonment and fined RMB 800,000. The courts affirmed that even if each constituent technique of the trade secret has been disclosed, the said trade secret shall be deemed as unknown to the public in its entirety, provided that the combination of the technique has yet been made public.


Representing Lacoste in the criminal enforcement and the following court action against an online distributor of counterfeit products, which was sentenced to pay a fine of RMB 4 million in total.


Successfully obtaining the first preliminary injunction by the Wenzhou Court against a local counterfeiter of Gillette Mach 3 razor cartridges and won the litigation thereafter.
