Zhejiang High Court provides clarification on trade name confusion (2023)
Plaintiff Johnson Electric, which was incorporated in Hong Kong on 25 April 1960, manufactures electric motors in mainland China via half a dozen affiliated companies, with the first one having been created in 1992. These affiliates use ‘Johnson’ as their English trade name and the Chinese characters ‘德昌’ as their Chinese trade name.

Beijing IP Court finds no bad faith in defensive trademark registration (2023)
In a recently surfaced administrative decision, the Beijing Intellectual Property Court has sided with the applicant for a defensive trademark, finding no foul play in the applicant’s conduct. Rendered on 26 December 2022, the decision considered whether the defensive trademark registration constituted a bad-faith application for a trademark that was not intended for use, which is banned by Article 4 of the 2019 China Trademark Law.

The Bureau National Interprofessionnel du Cognac (BNIC) is a coordination and decision-making body for the Cognac industry, comprising an equal number of winegrowers and merchants. The primary mission of the BNIC is to represent, foster and protect the geographical indication (GI) ‘Cognac’ in France and abroad. The BNIC owns registrations for the GI collective trademarks COGNAC and 干邑 (‘Cognac’ in Chinese characters) in Class 33 in China.

The consequences of a trademark invalidation (2022)
According to article 45 of the Chinese Trademark Law, a trademark owner who discovers the existence of a trademark registered subsequently to his own and considers that it is identical or similar and covers identical or similar goods, may request the TRAD (Trademark Revision and Adjudication Department) to invalidate the trademark. However, it is not possible to request the prohibition of its use.

Navigating Asia-Pacific’s Nontraditional Marks Maze (2022)
Registration of a nontraditional trademark is often an onerous task, and nontraditional trademark protection varies from jurisdiction to jurisdiction. In 2021, members of the Non-Traditional Marks Committee, Asia-Pacific Subcommittee developed a matrix summarizing the rules and practices of nontraditional trademarks in 26 Asia-Pacific countries and regions, namely, Australia, Brunei, Cambodia, China, Fiji, Hong Kong SAR, Indonesia, Japan, Kiribati, Laos, Macau SAR, Malaysia, Myanmar, New Zealand, Papua New Guinea, the Philippines, Samoa, Singapore, the Solomon Islands, South Korea, Taiwan, Thailand, Tonga, Tuvalu, Vanuatu, and Vietnam. In 2022, the matrix was updated by the new Subcommittee members. The matrix showcases registrable nontraditional trademarks throughout the Asia-Pacific region, perhaps offering practitioners and brand owners some insights on how to navigate the prosecuting landscape of nontraditional trademarks in the region.
